General Terms and Conditions of the Paketbeilagen Club (PBC)

The Paketbeilagen Club – Inshipments is a platform that allows members to establish contacts with each other over the Internet to conduct joint marketing activities. Membership is free in its basic version. Additional services, such as statistical analysis, the preservation of so-called news, link exchanges and links with the so-called social networks are offered in fee-based modules as Pro and Premium versions. PBC is committed to maintain the platform and to keep technical side up to date. If any failures occur and lead to disadvantages for the members and establish disorder, PBC and its leaders are liable only in cases of gross negligence or willful causation. The amount shall be liable to PBC – even considering the free of charge membership - in some cases on up to a maximum of 500. €.

PBC is entitles to suspend the platform with a period of one month of a calender month. PBC will inform all members about it in time, to ensure to deepen existing relationships and establish new one in the given time. Claims of any kind against PBC are excluded.

2. Membership, Termination, Violations of law

Membership may be terminated at any time with a period of one month to the end of month. The notice can be submitted via the fax.

The template used by the members, the coordinated activities with other members may not infringe rights of third parties and should not interfere. This is especially true for antitrust claims. If such claims are asserted against PBC, PBC will leave the legal defense to the members, so far as it is practicable. In any event, the members who filed any claim against PBC will reimburse all upcoming costs of legal representation for PBC.

3. Third Privacy, Jurisdiction, Other

The data provided by the member for the membership on PBC are subject to data law protection. They are particularly and exclusively used for the PBC platform and its purposes. The data will not be made accessible to third parties, sold or otherwise transferred. With the resignation of a member the member's data will be deleted unless they have to be kept for legal documentation.

Jurisdiction for all disputes from legal relationships between the members and PBC is Frankfurt am Main. Only the law of the Federal Republic of Germany is applicable for all legal relationships in this volume.

PBC is not responsible for the content of other websites that are linked and referred from PBC.
